These Terms of Service apply when you access mayacouture.co.za, place an order with Maya Couture, or use any service made available through our online store.

By using our website or placing an order, you agree to these terms and our Privacy Policy, Shipping Policy, and Return and Refund Policy.

1. Online store terms

You may use this website only for lawful purposes. You may not use the website to commit fraud, transmit malicious code, interfere with its operation, infringe another person’s rights, or violate any applicable law.

You must provide accurate and complete information when placing an order. You are responsible for maintaining the confidentiality of any customer-account login details.

2. Products and availability

We make reasonable efforts to display product descriptions, colours, images, sizing and other information accurately. The appearance of colours may vary depending on your screen or device.

Products and sizes are subject to availability. We may limit quantities or discontinue products without notice. Adding an item to your cart does not reserve it.

3. Prices and payments

Prices are displayed in South African rand unless stated otherwise. The total price, including applicable delivery charges, is shown at checkout before payment.

Payments are processed securely by the payment providers offered at checkout. Maya Couture does not directly store your complete card details.

We may correct an obvious pricing or product-information error. If an error affects an order you have already placed, we will contact you and provide an appropriate option, including cancellation and a refund where applicable.

4. Orders

An order is submitted when checkout is completed, but it is accepted only after payment has been authorised and the order has been confirmed.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, unauthorised payment, stock errors, obvious pricing errors, or misuse of a promotion. If we cancel a paid order, the amount paid will be refunded using the original payment method.

5. Shipping and delivery

Delivery charges, available destinations, estimated timeframes and other delivery conditions are described in our Shipping Policy.

Customers are responsible for providing accurate delivery details. Risk in the products passes as provided under applicable South African law.

6. Returns, exchanges and refunds

Returns, exchanges and refunds are handled according to our Return and Refund Policy and applicable South African consumer law.

Nothing in these terms is intended to exclude or restrict any right or remedy that cannot lawfully be excluded, including rights under the Consumer Protection Act and Electronic Communications and Transactions Act.

7. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions. Unless stated otherwise, discount codes cannot be exchanged for cash, applied retrospectively, or combined with another promotion.

We may withdraw or correct a promotion where there is an obvious error, fraud, abuse or technical failure, subject to applicable law.

8. Intellectual property

The content of this website, including its branding, text, photographs, graphics and designs, belongs to Maya Couture or is used with permission.

You may use the website for personal shopping purposes. You may not reproduce, distribute, sell or commercially exploit its content without prior written permission.

9. Third-party services

Our store is hosted by Shopify and may use third-party services for payments, delivery, analytics and other store functions.

Third-party websites and services may have their own terms and privacy policies. We are not responsible for third-party services beyond the extent required by law.

10. Customer reviews and submissions

If you submit a review, photograph, comment or other content, you confirm that you have the right to provide it and that it is not unlawful, misleading, abusive or infringing.

We may remove content that violates these terms or applicable law.

11. Disclaimer and limitation of liability

We aim to keep the website accurate, secure and available, but we cannot guarantee that it will always operate without interruptions or errors.

To the fullest extent permitted by law, Maya Couture will not be liable for indirect or consequential losses arising from the use of the website. This clause does not exclude liability that cannot legally be excluded or limit your statutory consumer rights.

12. Privacy

Personal information is handled according to our Privacy Policy and applicable South African data-protection law, including the Protection of Personal Information Act where applicable.

13. Changes to these terms

We may update these terms to reflect changes to our business, services or legal obligations. The latest version will be published on this website with its updated date.

Changes will not unfairly remove rights that have already arisen from an accepted order.

14. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with by a court or other body that has jurisdiction under applicable law.
